Haiti HOPE/HELP Outlasts Its 2026 ILO Funding Agreement
Haiti HOPE/HELP runs through 2028, but buyers placing 2027 apparel orders still need evidence that ILO factory oversight will cover their production commitments.

Congress has extended Haiti's HOPE/HELP trade preferences through December 31, 2028. The ILO's February announcement describes a financing agreement for factory oversight covering 2026. That difference gives apparel buyers placing 2027 orders a reason to follow the October 15 congressional appeal to keep the United States in the International Labor Organization. Before committing production, they need to establish how factory assessments and remediation will continue. House members' October 15 ILO letter, Haiti preference statute, section 213A(h), .
The letter asks Secretary of State Marco Rubio to explain by October 30 how the administration will preserve the ILO functions that support Haiti's market access. It describes a possible U.S. withdrawal, not a completed exit. Its warning deserves attention because the monitoring operation has already absorbed a funding withdrawal, well before the present membership debate.
Factory Assessments Resumed After U.S. Funding Ended
USTR's 2026 implementation report says Department of Labor funding for Better Work Haiti ended in March 2025. The ILO continued with a smaller team and support from its global Better Work revenue fund. For 2026, Haiti's Ministry of Economy and Finance provided $500,000 and apparel companies and retailers contributed more than $100,000 through buyer partnership agreements. That support kept the program operating. The published financing commitment does not cover the full trade preference period. USTR's 2026 Haiti report, page 2.
The reduced operation continued substantive work. Better Work's March 2026 report records 20 factory assessments and 68 advisory visits during 2025 and says it fulfilled its core mandate despite funding and staffing cuts. Assessments stopped from March through June 2025 and resumed in July. Better Work Haiti's 29th compliance report, pages 7 and 15.
Reporting nevertheless became less frequent. USTR says only one of the normally twice-yearly reports was produced during its June 1, 2025, to June 1, 2026, reporting period. It attributes that result to both resource limits and the October 2025 to February 2026 lapse in HOPE legislation. USTR's 2026 Haiti report, pages 2 and 8.
Assessments can continue while public reporting becomes less regular. A supplier's latest assessment date, remediation history and next review then become more useful than a general assurance that the program remains open.
Congress Kept the ILO's Statutory Role
Section 2009 of the September 2 law moved the statutory termination date from 2026 to 2028. It left the labor oversight architecture in place. The September renewal record should be read alongside the enacted extension.
Haiti must maintain the Technical Assistance Improvement and Compliance Needs Assessment and Remediation program, known as TAICNAR, and require participating producers to join it. Section 213A(e)(3)(C) specifies an operator, the ILO or one of its subdivisions, instrumentalities or designees. The duties include assessments, remediation assistance, follow-up visits and public reports. Better Work Haiti supplies the factory compliance component. Current statute, section 213A(e), USTR's implementation report, page 2.
This structure leaves room for delivery arrangements to change. The February financing announcement describes a transition that integrates compliance tools, grievance mechanisms and data systems into Haitian institutions under continued ILO technical oversight. It does not announce a shutdown in 2027. Nor does it establish that any private audit provider can replace the statutory operator. A proposed successor arrangement needs both operating capacity and the required institutional authority. ILO's financing and transition announcement.
Preference Suspension Requires a Separate Government Decision
The country program and an individual producer face different legal tests. Under section 213A(e)(1)(C), a presidential determination that Haiti no longer meets the program requirements calls for termination of the apparel preferences. The provision includes an exception when, after consultation with the relevant congressional committees, the President determines that extraordinary circumstances in Haiti make compliance impracticable. That exception requires a determination. A buyer cannot assume it applies. Current statute, section 213A(e)(1)(C).
For a producer, the sequence starts with an identification of noncompliance with core labor standards and relevant Haitian labor laws. The government must seek to help that producer comply. If those efforts fail, the President must withdraw, suspend or limit preferences for its articles. The statute requires the President to consider the program's reports when identifying noncompliant producers, while permitting other evidence. USTR explains that producer identification has been delegated to the Labor Secretary in consultation with USTR. The Labor Secretary also holds the delegated assistance function. Current statute, section 213A(e)(4)(B), USTR's 2026 Haiti report, pages 8 and 9.
An ILO withdrawal announcement, an expiring financing arrangement or a missing report would therefore warrant a different response from a formal preference action. None establishes, by itself, that a particular factory's next shipment has lost HOPE/HELP treatment. Equally, the 2028 end date does not eliminate either the country or producer review process.
The Supplier File Must Cover the Production Period
For a 2027 purchase commitment, the useful record is the named factory's labor eligibility history. The table separates the evidence a buyer can seek from the conclusions it supports. These are sourcing controls inferred from the statutory structure, rather than new customs filing requirements.

The first row cannot substitute for the third. Funding an inspection program does not resolve a factory's labor violations. Conversely, a factory's completed corrective action cannot establish that the program will have the resources to assess it again. Procurement and compliance teams need to connect those two records before committing production across an unconfirmed service period.
October 30 Offers a Chance to Clarify the Plan
Lawmakers' requested October 30 response date provides a near-term opportunity for clarification. A useful administration response would identify how TAICNAR's required functions will continue, who will perform them and what financing period the plan covers. A statement about U.S. membership alone would leave the buyer's 2027 question unanswered. House members' questions to Secretary Rubio, page 3.
Evidence of a funded arrangement covering 2027, with an operator authorized under the statute and a credible assessment schedule, would support longer sourcing commitments. Buyers without that confirmation can attach a review point to future order releases and obtain updated factory information. For a buyer releasing a 2027 order, confirmation of the next assessment is more useful than another assurance about the 2028 expiry date.
