Japan's Fresh Potato Talks Turn on Replacing Chip-Factory Safeguards
Japan's fresh potato talks must replace chip-factory pest controls, making supplier eligibility and outbreak rules central to the value of any opening.

Japan's fresh potato negotiations have reached the point where the supply map matters. On October 23, Agriculture Minister Arata Takebe said Japan had moved into consideration of risk-management measures after identifying and publishing 21 pests in September. He declined to disclose the bilateral details. The public record establishes a new negotiating stage, with the terms of access still to be settled. MAFF, October 23 press conference on U.S. fresh potato negotiations
For a U.S. exporter planning table-stock sales, the commercial question is which farms could qualify, and how much supply would remain available after a pest detection. Japan's existing potato-chip route offers a useful starting point. Its protections extend beyond the farm, all the way into the fryer. General distribution would remove that controlled endpoint.
The current route ends inside a chip factory
Japan already permits a tightly controlled trade in raw U.S. potatoes for chip processing. Its conditions require designated production regions free of golden and pale cyst nematodes, surveys, controls on movement of host plants, and shipment in sealed containers. The phytosanitary certificate identifies the processing use and treatment at a designated facility. MAFF Notification No. 114, production, transport and certification conditions
The same rules reach into the factory. Equipment must prevent tubers and processing residues from escaping. Potatoes are sliced and immersed in oil at 130 degrees Celsius or above for at least two minutes. Residues and specified materials must be destroyed or receive equivalent treatment. That sequence gives the importing authority control over what happens after the container arrives.
A chip supplier's successful shipments therefore establish experience with a particular route. They do not establish eligibility to sell the same potatoes through wholesalers, supermarkets or restaurants. The end use is part of the protection system.
Fresh distribution moves more of the work to the exporter
MAFF's September explanation draws this distinction explicitly. General-distribution potatoes would not have the chip route's closed handling and heat treatment. Some could also be diverted to planting. Japan says sufficient risk-management measures must consequently be implemented in the United States. MAFF, September briefing, pages 9 and 10
The implication is a different qualification exercise for exporters. A packer needs to establish which combination of production controls, testing and handling can support the intended route. A national market-opening announcement would leave that work unfinished unless its conditions identify an achievable path from farm to certificate.
The comparison below separates existing controls from questions the eventual fresh-potato terms would need to resolve.
Control point
Existing chip route
Question for general distribution
Production
Designated regions and controls for two cyst nematodes
Which pest-specific conditions determine eligible farms and regions?
Handling
Sealed shipment to a designated processing facility
Which controls remain effective through the fresh distribution chain?
Final treatment
Required heat processing and residue disposal
Which alternative measures achieve the required protection?
Supply continuity
Eligibility depends on documented plant-health conditions
How narrowly is a detection contained, and what restores eligibility?
These are commercial diligence questions, not a summary of an agreed protocol. The 21-pest negotiation does not establish that every pest will require the same measure, territory or test.
The boundary of an approval determines its commercial value
A region acceptable for one pest can still fail another condition. Usable supply would come from farms satisfying the complete protocol. National production totals cannot answer that question.
Existing practice shows what a documented supply base can entail. Japan's implementation rules for chip potatoes require field examinations, specified soil testing, seed-potato provenance and retention of survey and production records. Those are current processing requirements, not advance instructions for the proposed fresh trade. They nevertheless show why exporters should start with identifiable farms and records rather than a country-level assurance. MAFF, U.S. potato import implementation rules, sections 2 and 3
The international framework also makes geography specific to the pest. ISPM 4 calls for identification of the target organism and recognizable boundaries consistent with its biology. It permits pest-free status following eradication and provides for delimiting an outbreak area, temporary suspension and reinstatement after defined criteria are met. IPPC ISPM 4, sections 1, 2.4 and 3.4-3.5
For an exporter, the restoration provision belongs in the commercial assessment alongside initial eligibility. If an eventual protocol suspended an entire region after one detection, buying from two growers within that region would offer little protection against that closure. A narrower suspension could preserve alternative supply, provided the remaining sources met all other conditions. Neither outcome can be assumed before the terms are known.
Plant-health evidence has to survive both governments' tests
The United States already distinguishes between different field statuses. APHIS reports that pale cyst nematode remains contained within an 8.5-mile-radius area in southeast Idaho. Its procedures distinguish positive, suspect and inconclusive results. For associated fields, deregulation requires two negative delimiting surveys, each after harvest of one of the next two host crops. That procedure is distinct from proving eradication in an infested field. APHIS also cautions against assuming that a nonregulated field is pest-free. USDA APHIS, pale cyst nematode status and survey definitions
These distinctions matter when selecting evidence for Japan. A domestic regulatory classification is a starting record. It does not establish Japanese acceptance or clear a farm against every pest under discussion.
Under Article 6 of the WTO SPS Agreement, importing members must adapt measures to regional conditions, while exporting members claiming pest-free areas must provide objective evidence that those areas are, and are likely to remain, pest-free. Article 4 requires acceptance of different measures as equivalent when the exporting member objectively demonstrates that they achieve the importing country's appropriate level of protection. WTO SPS Agreement, Articles 4 and 6
The trade-restrictiveness test is also qualified. Under Article 5.6 and footnote 3, a measure is more trade-restrictive than required only if a reasonably available alternative is technically and economically feasible, achieves the importing country's appropriate level of protection and is significantly less restrictive. A workable counterproposal needs evidence on those elements. The public negotiating record does not establish a WTO violation.
A sales commitment needs a qualified supply plan
An export manager can prepare that plan before the talks conclude. Identify prospective farms, connect them to survey and seed records, and establish which packing and storage practices preserve origin information. Mark each proposed source against the conditions still awaiting agreement. This is preparation for qualification, not permission to ship.
Before committing firm fresh-market volumes, the decisive evidence would be published Japanese conditions, a usable certification route and confirmation that the proposed supply meets them. The suspension unit and restoration criteria would then determine how to assess backup suppliers and interruption risk.
