UK-EU SPS alignment would end GB-only novel food exclusivity for U.S. exporters

U.S. novel food exporters should separate returns achievable under current GB approvals from sales that would depend on EU authorization after alignment. Recalculate launch payback using the planned mid-2027 transition, while treating the final timing and exceptions as unresolved.
British regulators' September 30 guidance explains how cell-cultivated foods can obtain domestic approval while the planned UK-EU sanitary and phytosanitary (SPS) agreement would replace that approval system. For U.S. producers, the launch decision turns on sales before alignment and permission to keep selling afterward.
Under the planned agreement, GB novel food approvals and their associated data-protection exclusivity would cease when alignment takes effect, subject to any agreed exceptions. A GB approval can still support sales under current rules, so a late-stage application may retain value. Before further spending, compare achievable pre-alignment returns with the cost of securing usable EU authorization, checking the product specification, permitted uses and any restrictions on access to another applicant's protected listing. The government is preparing for mid-2027 implementation, but the final timing and transition terms remain unresolved.
