Section 301 refund claims can outlast the November 9 exclusion expiry

Importers reviewing China Section 301 entries affected by the five amended exclusions should check product eligibility and liquidation status now, then confirm the applicable post-summary correction or protest deadline. November 9 is not a common refund-claim deadline.
China Section 301 exclusions are scheduled to expire November 9, but five amended exclusions warrant a review of earlier entries now. Their code changes took legal effect July 1, before ACE accepted the first four amendments on September 23 and the fifth on October 23.
Start with qualifying pump parts, listed plastics and specified metal-shredder parts entered during those implementation gaps, then check later entries for omitted claims. Match the old and new HTS numbers, the exclusion's product limits and duties actually paid. For unliquidated entries, check post-summary correction (PSC) eligibility and the applicable deadline. After liquidation, a protest may be available, generally within 180 days after liquidation or reliquidation, even if the earlier PSC window closed.

Representative Don Beyer has pledged to pursue tariff repeal without naming a legislative vehicle. If Democrats use reconciliation, a committee title that increases deficits beyond the budget window could expose its revenue-losing provisions to a Byrd-rule challenge. A sunset is one possible response, but continuing offsets within that title or a successful waiver could change the result. Keep current duties as the operating baseline, and use any proposed bill text and budget estimate to model the scope and duration of a relief scenario.
