Fresh Tomatoes From Mexico: Termination of Suspension Agreement, Rescission of Administrative Reviews, and Imposition of an Antidumping Duty Order On April 14, 2025, the U.S. Department of Commerce (Commerce) gave 90 days' notice of its intent to withdraw from the 2019 Agreement Suspending the Antidumping Duty Investigation on Fresh Tomatoes from Mexico (2019 Agreement), terminate the 2019 Agreement, and institute an antidumping duty (AD) order. Accordingly, Commerce is withdrawing from and terminating the 2019 Agreement, rescinding both of the ongoing administrative reviews of the 2019 Agreement, and issuing an AD order on fresh tomatoes from Mexico.
Fresh Tomatoes From Mexico: Notice of Court Decision Not in Harmony With the Final Determination of Antidumping Duty Investigation; Notice of Amended Final Determination On April 17, 2025, the U.S. Court of International Trade (CIT) issued its final judgment in Bioparques de Occidente, S.A. de C.V., et al. v. United States, Slip Op. 24-43, Consol. Court No. 19-00204, sustaining the U.S. Department of Commerce (Commerce)'s remand redetermination pertaining to the antidumping duty (AD) investigation of fresh tomatoes from Mexico covering the period of investigation (POI) March 1, 1995, through February 29, 1996. Commerce is notifying the public that the CIT's final judgment is not in harmony with Commerce's final determination in that investigation, and that Commerce is amending the final determination with respect to the dumping margin assigned to all Mexican tomatoes producers and exporters individually examined in this investigation.

De C.V (VALHPAC) (collectively, respondents), were in compliance with the terms of the 2019 Agreement Suspending the Antidumping Duty Investigation on Fresh Tomatoes from Mexico (2019 Agreement) during the period of review (POR) from September 1, 2021, through August 31, 2022, except for certain instances of inadvertent or inconsequential noncompliance. Fresh Tomatoes From Mexico: Final Results of the Expedited Sunset Review of Suspended Investigation As a result of this sunset review, the U.S. Department of Commerce (Commerce) finds that termination of the 2019 Agreement Suspending the Antidumping Duty Investigation on Fresh Tomatoes from Mexico would be likely to lead to continuation or recurrence of dumping at the levels indicated in the "Final Results of Review" section of this notice.

Commerce also preliminarily determines that another respondent selected for individual examination, Agricola Globalmex, S.A. de C.V. (Globalmex), complied with certain requirements of the 2019 Agreement during the POR. Additionally, Commerce preliminarily determines that the 2019 Agreement functioned as intended and continued to meet the statutory requirements under sections 734(c) and (d) of the Tariff Act of 1930, as amended (the Act) during the POR. Commerce requires additional information from two respondents, Globalmex and NatureSweet Invernaderos S. de R.L. de C.V./ NatureSweet Comercializadora, S. de R.L. de C.V. (collectively, NatureSweet). We intend to examine the additional requested information in a post-preliminary determination.

Because a new suspension agreement has not been signed, Commerce is withdrawing from and terminating the suspension agreement, rescinding the administrative review of the 2013 Agreement, and continuing the antidumping duty (AD) investigation.
