BIS DPAS Directive Mandates 100% Domestic Allocation of Black Mass and Tungsten Scrap Sales

Effective August 27, 2026, U.S. persons selling black mass or tungsten waste and scrap must allocate 100% of monthly sales to U.S. buyers under a new DPAS Directive, unless BIS grants an advance adjustment or exception. The rule is authorized under Section 101 of the Defense Production Act and a July 30, 2026 Presidential Determination on recoverable critical minerals and materials.
