Proclamation 11061 Excludes 53 Lines of Canadian Alcoholic Beverages From Importation (Section 338)
Proclamation 11061 of September 8, 2026 (91 FR 58311) excludes from importation, for goods imported on or after 12 01 a.m. ET September 29, 2026, 53 HTS lines of Canadian beer, wine, cider, sake and other fermented beverages, beverage ethyl alcohol, vermouth, brandies, whiskies, rum, gin, vodka, liqueurs, bitters, tequila, mezcal and other spirits (about 28 lines limited to packaged goods) under section 338 of the Tariff Act of 1930 (19 U.S.C. 1338). The goods move from the 50 percent Section 338 duty of Proclamation 11046 to the exclusion, goods imported earlier but entered later remain dutiable at 50 percent, and the duty is restored if the exclusion is invalidated.
What changed
A Federal Register proclamation (Doc. 2026-18835, Sept. 14, 2026) directs the exclusion of certain Canadian products from entry into the United States, citing Canada's continued discrimination against US alcoholic beverage commerce. The action constitutes a targeted import restriction against Canada and appears to invoke retaliatory trade authority in response to discriminatory provincial liquor-board practices.
