Proclamation 11065 Modifies the Section 338 Motor-Vehicle-Response Duty List for Canada (Heading 9903.03.14)
Proclamation 11065 of September 8, 2026 (91 FR 58339) amends U.S. note 51(b)(3) effective 12 01 a.m. ET September 15, 2026, it deletes eight subheadings (2501.00.00, 2523.29.00, 2940.00.60, 4803.00.40, 4818.90.00, 7801.10.00, 8537.10.91, 9507.10.00) and inserts 82 (0406.90.99, writing paper of 4802, structural steel of 7308.90, aluminum bars and tubes of 7604/7608, base-metal fittings of 8307-8311, 8537.10.91xx statistical lines, 8703.10.50 and 8703.21.01, outboard boats, seats and furniture of 9401/9403/9404, lamps of 9405, 9507.10.0040). Annex II section 2 narrows note 51(c) to heading 9903.03.13, ending the §232 carve-out for this list, the duties apply in addition to §232 duties.
What changed
A Federal Register proclamation (Doc. 2026-18839, published 2026-09-14) modifies the scope of Canadian products subject to additional duties imposed to offset alleged Canadian discrimination against US commerce in motor vehicles. The action adjusts which Canadian-origin goods fall within the existing additional-duty framework in the automobile sector. This is an executive branch tariff-scope adjustment targeting.
