CAPE Phase 3 Ties October 6 Filing to July 30 IOR Submissions
CBP plans to open CAPE Phase 3 on October 6 for plaintiffs with reliquidation orders and a valid IOR number submitted by July 30. Later submitters await instructions.
CBP has scheduled CAPE Phase 3 for October 6, 2026, but the first filing group is defined by a submission made months earlier. In its September 15 court declaration, the agency says plaintiffs that submitted a valid importer of record number by July 30 can file when the new phase opens. Plaintiffs that provided an IOR number later will receive additional instructions.
The announced phase covers finally-liquidated entries filed by plaintiffs for which the court has ordered reliquidation. To prepare an October 6 filing, a customs manager needs counsel's actual IOR submission beside the court order and entry list.
