Gellert seeks Canada tariff halt for all importers, refunds only for itself

Importers other than Gellert should not count on refund cash from this motion. The proposed refund provisions name Gellert alone, so a broader halt to Canada tariff collection would not by itself establish other importers' repayment rights.
Gellert's October 23 motion seeks a halt to Section 338 Canada tariff collection for all importers. Its proposed refund provisions name only Gellert, including entries under its former name, Atalanta.
The motion does not seek relief from the separate import bans and does not itself change duty collection. Apply the separate October 30 product-scope changes to covered goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. Eastern that day. Before incorporating litigation-based duty savings into a forecast, check any court order's coverage, effective terms and whether it is stayed. Refund coverage must be assessed separately from a halt to future collection.

The HD name alone does not establish tariff classification or eligibility. Investment teams should match planned vehicle specifications, tariff classifications and U.S. shipment dates to any implementing schedule and its duration. Until those terms are settled, keep relief conditional in the capital forecast.
