Procedures To Consider Requests for Exclusion of Particular Products From the Determination of Action Pursuant to Section 301: China's Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation

U.S. importers of Chinese goods subject to Section 301 tariffs tied to China's technology transfer and intellectual property practices may seek product-specific exclusions, but must demonstrate severe economic harm or that the tariff is otherwise not achieving its intended purpose. The exclusion process was opened by USTR on the same date as this hearing, making the procedural requirements immediately operative.
