The Congressional Automatic-Refund Track Is Pressure, Not a Payment Path
Sen. Tim Kaine's automatic-refund amendment did not survive the Senate vote-a-rama, and the June 3 House letter creates oversight pressure rather than a refund right. For an importer of record, payment still turns on CAPE processing and the Federal Circuit appeal, while the pass-through economics behind the political case now feed consumer class actions against importers collecting refunds.
The IEEPA Refund Fight Now Comes Down to Rule 23
The Supreme Court settled that IEEPA confers no tariff authority, but not which importers and which entries can be refunded, or how. After Trump v. CASA limited universal injunctions, the June 4 Rule 23 class certification motion tests whether a class action is the procedural vehicle that can carry relief to nonlitigant importers whose finally liquidated entries sit outside CAPE's current scope.
